1. Eligibility & Use of Services

By using our services, you confirm that you are at least 18 years of age and legally capable of entering into binding agreements.

You agree to use the website and services for lawful purposes only and in compliance with all applicable laws and regulations.

2. Products & Services

The Company provides food and grocery delivery services, including one-time purchases and subscription-based offerings.

All products are subject to availability. The Company reserves the right to:

  • Limit quantities

  • Discontinue products without notice

  • Substitute products of equal or greater value

  • Modify product offerings at any time

Product descriptions and images are for informational purposes only and may vary from actual items delivered.

3. Orders & Payments

All orders are subject to acceptance by the Company.

Prices, fees, and charges are displayed at checkout and may change without prior notice.
By submitting an order, you authorize the Company to charge your selected payment method for the full amount, including applicable taxes, delivery fees, and recurring charges (if applicable).

All payments are final and non-refundable, except where required by law.

4. Subscriptions & Recurring Billing

Subscription services automatically renew according to the selected delivery and billing frequency unless properly canceled in accordance with the applicable subscription policy.

You authorize recurring charges to your payment method and acknowledge responsibility for maintaining valid payment information.

The Company is not responsible for failed payments, service interruptions, or missed deliveries resulting from invalid or declined payment methods.

5. Delivery Terms

Delivery times are estimates only and not guaranteed.

The Company shall not be liable for delays or failures caused by:

  • Weather conditions

  • Traffic

  • Third-party carriers

  • Acts of God

  • Events beyond reasonable control

If a delivery cannot be completed due to customer unavailability, incorrect address, or access issues, the order will be considered fulfilled and no refund or replacement will be issued.

6. Food Safety & Risk Assumption

Once products are delivered, responsibility for proper storage, handling, and consumption transfers entirely to the Customer.

The Company makes no guarantees regarding freshness, shelf life, or suitability beyond delivery.
Consumption of food products is done at the Customer’s own risk.

7. Allergies & Dietary Responsibility

Customers are solely responsible for reviewing product descriptions and ingredient information.

The Company does not guarantee allergen-free products and assumes no liability for allergic reactions, dietary conflicts, or health outcomes.

8. Returns, Refunds & Cancellations

All sales are final.

Returns, refunds, exchanges, or credits are not permitted, except as expressly stated in the Company’s Return & Refund Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

All website content, including text, images, logos, designs, and trademarks, is the exclusive property of Sunny Farms Delivery and may not be copied, reproduced, or used without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any damages of any kind arising from the use of the website, services, products, or deliveries.

In no event shall the Company’s total liability exceed the amount paid by the Customer for the specific order giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless the Company, its owners, employees, contractors, and partners from any claims, damages, losses, or expenses arising from:

  • Your use of the services

  • Violation of these Terms

  • Consumption or misuse of products

12. Service Modifications & Termination

The Company reserves the right, at its sole discretion, to modify, suspend, or terminate services, accounts, or access to the website at any time without notice or liability.

13. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which the Company is registered, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts of that jurisdiction.
